Welcome to my Privacy Policy. Your privacy is critically important to me.

Emma Stewart Cake Design, is deemed to be a ‘data controller’ and is registered with the Information Commissioners Office (ICO), registration number: ZA840966. Unless I am obliged or permitted to do so by law, I will not disclose any of your personal information (data) to another third party without your consent.

 

I will never pass your information to any company so that they may market their products to you however they may be able to target marketing to you as a result of cookies that are utilised as a result of Google Analytics or Facebook Pixels – please refer to my Cookie policy for further information as how to change your cookie settings.

 

 

WHAT INFORMATION I COLLECT ABOUT YOU

 

I may collect the following information, which includes personal information from you, when you visit my website, provide your details via an opt in form, when you subscribe to my mailing list, join the Emma Stewart Cake Academy Facebook group, newsletter or updates, or request some information to be sent to you:

  • Name

  • Contact details such as email addresses or telephone numbers

  • Wedding details if it is a wedding enquiry

  • IP Address of your computer

  • Cookies

 

In the event that you purchase a product or request a service from me, the above information will also be collected together with your address and payment details. Please note that whilst payment details will be collected as part of the online payment process, this information will not be stored by ourselves. If you purchase a product/service via the website, I use Wix Payments and PayPal to process the payments. Please refer to Wix Payments (who use Wix Payments, Adyen N.V. and Stripe) and PayPal’s privacy policies for further information as to what they do with your personal information. In the event that an invoice is provided directly from myself, your bank details may be retained by my preferred banking partner (Monzo) or PayPal.

 

 

WHY I COLLECT THIS INFORMATION ABOUT YOU

 

The data collected will be used by me to:

  • Contact you if you have made an enquiry via the website or within a Facebook group or other social media platform or if you asked me to contact you.

  • Provide you with information that you have requested, including updates which I feel may be of interest to you or your business.

  • Include you in the email subscription process in order that you may receive the newsletter or regular email updates or any other updates you may have requested.

  • Fulfil the purchase you have requested on the website or from me directly.

  • Provide the service that you have requested from me and made payment for.

  • Contact you to discuss your purchase and whether you have any queries.

  • Conduct analysis on any products/services that are purchased to look at trends and to understand what my customers desire and need.

  • Provide you with updates related to your products that I feel may be of interest to you.

  • Accountancy purposes.

WHEN CAN I USE YOUR PERSONAL INFORMATION?

 

I will contact you based on the following:

  • I will contact you based on the understanding that you have submitted your personal details, requesting further information from me, which I deem to be a legitimate business interest.

  • I will contact you when you arrange an appointment with me, on the basis that I am fulfilling a pre-contractual requirement with you.

  • In the event that you sign up for a service/subscription with me or purchase a product, I will be using your personal information to enable us to fulfil the contract you have with us.

  • If you have provided a testimonial for me to use, I deem this to be a legitimate business interest.

  • In relation to the legal requirements I have for accountancy purposes.

  • If you have provided consent for me to provide you with marketing emails, to keep you informed of products, services and things we feel may be of interest to you.

 

 

WHO MIGHT YOUR PERSONAL INFORMATION BE PROVIDED TO?

 

I will only share your personal information with trusted partners where I am required to in order to fulfil my obligations to you. If I do share it, I will ensure appropriate due diligence is carried out, so I am confident the necessary regulations are being met.

Your personal information may be shared with other companies to help me analyse and better understand my customers and their requirements.

 

At the time of writing this policy, the trusted partners are:

  • Mailerlite - which is used to record appropriate personal information to enable me to fulfil myr obligations to you, in relation to providing regular updates.

  • Stripe - which is used in relation to collecting payments online.

  • Wix Payments - which is used by Wix to accept and process payments online.

  • PayPal - which is used in relation to collecting payments online.

  • Wix - which is used to host the website and ecommerce store.

  • Google Docs/Dropbox - which may be used to transfer and store personal information.

  • Invoice Simple - which is used to send invoices for services not purchased directly from the website, such as wedding cake consultations, tasters or wedding cake balances.

 

 

HOW I PROTECT YOUR PERSONAL INFORMATION (GDPR)

 

Personal information that you enter into the website, in relation to enquiries, will be sent directly to me to enable me to enact upon your request. Where you purchase a product online, basic information will be retained within the website.

To keep your personal information secure, I store it using standard encryption and information security policies, appropriate for the business. This means that your information is only accessible to individuals who are authorised to access it and only within my approved locations. If your personal information is transmitted to any of my trusted partners, appropriate security measures are in place to ensure it is not intercepted.

LOCATION OF YOUR PERSONAL INFORMATION

 

The recipient of any personal information submitted on the website, or via an opt in form, will be Emma Stewart Cake Design and all data is retained in the UK. There may be occasional operational requirements to transfer your data outside of the UK, as a result of some of the 3rd parties we may use from time to time, however if I do this, the same degree of protection is given to your personal information as if it was stored and used within the UK and regulated in line with it’s laws.

 

 

RETENTION PERIOD OF YOUR PERSONAL INFORMATION

 

Your personal information will be retained for as long as necessary in line with the legal reasons for utilising this information. When your information is no longer required it will be securely deleted from my records and any 3rd parties. Further information in relation to how long your personal information will be retained is available upon request.

 

 

YOUR RIGHTS

 

In relation to the personal information that I hold about you, you may have the following rights:

  • You have the right to ask to see what data I hold about you.

  • You have the right to access your personal information. If you wish to obtain a copy of the information I hold about you please contact the Emma Stewart Cake Design in writing with the subject ‘Subject Access Request’. Generally, the information will be provided within one month, however, please be aware that I will take necessary steps to confirm your identity prior to releasing any personal information for your own security.

  • If you believe the information I hold about you to be incorrect or incomplete you have the right to ensure this is rectified. For further information please contact Emma Stewart Cake Design. Any corrections should typically be complete within one month.

  • You have the right to be forgotten. In specific circumstances, you will have the right to have your personal information erased or to prevent processing. I can refuse your request for erasure if I have a legal obligation to continue to hold your personal information, but I will inform you if this is the case.
